Terms & Conditions
Terms applicable to DialloGeo's geomatics services.
Terms applicable to DialloGeo's geomatics services.
These terms and conditions (T&Cs) govern the geomatics services (collection, analysis, mapping and training) provided by Ibrahima Sory Diallo, sole trader (French entrepreneur individuel) trading under the name Diallo Geo (brand DialloGeo; SIREN 988 751 616, Trade and Companies Register: Besançon 988 751 616), to professional clients only: businesses, local authorities, public bodies and organisations acting in the course of their activity. They do not apply to consumers; services offered to private individuals (IT repair and support) are governed by the terms of the numerique.diallogeo.fr portal (in French). Any order implies unreserved acceptance of these T&Cs.
Each service is the subject of a detailed, free quote valid for 30 days. The order becomes firm upon receipt of the dated, signed quote together with any deposit. Any change to the scope is handled via an amendment.
Services are billed on a time basis (average day rate €350, rising to €400-450) or at a fixed price for scoped deliverables. Prices are in euros, net of tax: VAT not applicable, article 293 B of the French General Tax Code.
Payment terms are as follows:
Payment by bank transfer (IBAN provided on the invoice). In accordance with article L. 441-10 of the French Commercial Code, any late payment by a business client automatically incurs penalties at three times the French statutory interest rate (taux d'intérêt légal), plus a fixed €40 recovery fee (article D. 441-5 of the same code). For public-sector buyers, late-payment interest and the fixed fee are those set by the French Public Procurement Code.
Goodwill: free territory map for local-authority prospecting · preferential rate on annual GIS database maintenance.
Deadlines stated in the quote are indicative and run from receipt of the deposit and of the data required from the client. Any delay in the client providing data postpones delivery accordingly. Deliverables are provided digitally (and in print on request).
Cartographic outputs are protected works. The transfer of usage rights to the client is specified in the quote or contract; rights transfer only after full payment. Data sources (OpenStreetMap — ODbL, IGN / cadastre — Etalab Open Licence) are cited as mandatory on outputs. Any personal-data processing complies with the GDPR (see the privacy policy).
These T&Cs are governed by French law. In the event of a dispute, an amicable solution will be sought first. Failing that, any dispute will be submitted to the jurisdiction of the courts of Besançon, France.
